APP PRIVACY POLICY

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – GDPR), HÉCTOR LINARES MORALES hereby informs users of the PeritCam application (hereinafter, the Application) regarding the processing of personal data which they have voluntarily provided during the process of registration, access and use of the service.

IDENTIFICATION OF THE DATA CONTROLLER.

HÉCTOR LINARES MORALES, with CIF/NIF number: 20248892Z and address for notification purposes at: C/ Els Ports, 3, CP 12005 – Castellón (Castellón de la Plana) (hereinafter, the Data Controller), is the entity responsible for the processing of the data provided by the clients of the Application (hereinafter, the User/s).

PURPOSE OF DATA PROCESSING.

In order to proceed with the registration, access and subsequent use of the Application, the User must provide - voluntarily - personal data (mainly identification and contact information), which will be incorporated into automated media owned by HÉCTOR LINARES MORALES.

The collection, storage, modification, structuring and, where appropriate, deletion of the data provided by the Users, will constitute processing operations carried out by the Controller, with the purpose of guaranteeing the correct functioning of the Application, maintaining the service provision and/or commercial relationship with the User, and for the management, administration, information, provision and improvement of the service.

The personal data provided by the User - especially the email address - may also be used to send newsletters, as well as commercial communications regarding promotions and/or advertising of the Application, provided that the User has previously given his or her express consent to receive these communications electronically.

In addition, data relating to the User's geolocation or location will be collected provided that the User gives his/her express consent to do so and has activated this functionality on his/her device. Data relating to the image, whether in the form of a photograph or video, will also be collected under the same conditions as those established above.

LEGITIMATION.

The processing of User data is carried out on the following legal bases that legitimize it:

• The request for information and/or the contracting of the services of the Application, which will be contracted through the web https://www.peritcam.com.
• The free, specific, informed and unequivocal consent of the User, by making this privacy policy available to him/her, which he/she must accept by means of a statement or a clear affirmative action, such as checking a box provided for this purpose.

If the User does not provide HÉCTOR LINARES MORALES with his/her data, or does so in an erroneous or incomplete manner, it will not be possible to proceed with the use of the Application.

CONSERVATION OF PERSONAL DATA. 

The personal data provided by the User will be kept in the systems and databases of the Data Controller, as long as the User continues to use the Application, and as long as the User does not request its deletion.

In order to clarify any potential liability arising from the processing, the data will be retained for a minimum period of five years.

RECIPIENTS.

The data will not be communicated to any third party other than HÉCTOR LINARES MORALES, except under legal obligation or in any case, upon request of the User's consent.

Furthermore, HÉCTOR LINARES MORALES may grant access to or transmit the personal data provided by the User to third-party service providers with whom it has signed data processing agreements, and who only access said information to provide a service in favour of and on behalf of the Controller.

PROTECTION OF HOSTED INFORMATION.

The Data Controller adopts the necessary measures to guarantee the security, integrity and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of such data.

Although the Controller makes backup copies of the content hosted on its servers, it is not responsible for the loss or accidental deletion of data by Users. Likewise, it does not guarantee the complete replacement of data deleted by Users, since the aforementioned data may have been deleted and/or modified during the period of time elapsed since the last backup copy.

The services provided or rendered through the Application, except for specific backup services, do not include the replacement of content stored in backup copies made by the Data Controller, when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always subject to prior acceptance by the user. The replacement of deleted data is only included in the price of the service when the loss of content is due to causes attributable to the Data Controller.

In addition, the App contains two service functionalities relating to storage by the Controller:

1. Option 1. The Controller will not store the online appraisals carried out by the User, and the User will therefore be responsible for their storage and management, exempting the Controller from any subsequent claim in the event of the loss of said data.
2. Option 2. The Controller also provides the service of storing the expert reports online, with the User being able to download the information from them or not. In these cases, the Controller will generate and provide the User with a QR code for later access.

EXERCISE OF RIGHTS.

HÉCTOR LINARES MORALES informs the User that he/she has the right to access, rectification, limitation, deletion, opposition and portability, which he/she may exercise by sending a request to the following email address: info@informaticoscastellon.com.

Likewise, the User has the right to revoke the consent initially given, and to file claims of rights before the Spanish Data Protection Agency (AEPD).

COMMERCIAL COMMUNICATIONS BY ELECTRONIC MEANS.

In application of the LSSI (Information Society Services Act), HÉCTOR LINARES MORALES will not send advertising or promotional communications by email or other equivalent means of electronic communication that have not previously been requested or expressly authorized by the recipients thereof.

In the case of users with whom there is a prior contractual, legal or service relationship, the Data Controller is authorized to send commercial communications regarding products or services of the Controller that are similar to those that were initially contracted with the client.
